Term of Conditions

STANDARD CONDITIONS OF CONTRACT – Delta EcoWild Safaris

1. Definitions

  • Operator: Delta EcoWild safaris
  • Safari: Package tour or related services offered by the Operator.
  • Client: The individual or group member(s) booking the safari.
  • Group: Two or more persons booked together.

2. Environmental Responsibility

  • Clients must avoid harming the environment (e.g., no littering, no use of unauthorized insecticides, no bathing with soap in rivers).
  • Peaceful, respectful behaviour toward wildlife and others is expected.
  • Smoking may be prohibited depending on Operator’s discretion.

3. Safari Rules & Safety

Clients must follow all Operator instructions, including:

  • Stay seated while vehicles are in motion.
  • Do not exit vehicles in game areas unless directed by the guide.
  • Remain in designated campsites/picnic areas.
  • Take safety precautions against fire, sun, and heat.

4. Baggage and Equipment

  • Dangerous or illegal goods are prohibited.
  • For fly-in safaris, baggage is limited to 1 soft bag, max 20 kg (incl. camera gear).
  • Additional luggage space can be arranged with 14 days’ advance notice.

5. Health & Documentation

  • Clients must ensure they are fit to travel and possess all necessary travel documents.
  • Compliance with health and immigration requirements is the client’s responsibility.

6. Risks & Dangers

Clients acknowledge the inherent risks, including:

  • Encounters with dangerous wildlife (lions, hippos, snakes, etc.).
  • Exposure to diseases (e.g., malaria, bilharzia).
  • Physical exertion, extreme weather, vehicle recovery assistance.
  • Sunburn, dehydration, and heat exhaustion.

Participation in the safari is at the client’s own risk.

7. Liability

  • The Operator is not liable for injuries, loss, damage, or delays, even if caused by negligence.
  • No liability for loss/damage of baggage or equipment.
  • No refunds for unavailable services due to unforeseen events.
  • Liability limitations also apply to Operator’s agents and staff.

8. Insurance Responsibility

Delta EcoWild Safaris does not automatically arrange travel insurance on behalf of clients. Insurance will only be arranged if the client provides clear written instructions requesting this service.

If we do assist in arranging insurance, it will be subject to the terms, conditions, and standard exclusions of the insurance company or underwriters providing the coverage. Delta EcoWild Safaris may place the insurance under an open or general policy on behalf of the client.

Please note:

  • If any dispute arises regarding an insurance claim, the client’s recourse will be directly with the insurance company, not with Delta EcoWild Safaris.
  • The Operator will not be held liable if an insurer refuses a claim, even if the insurance premium was paid to or through the Operator.
  • Insurance premiums may differ from what was charged by or paid to Delta EcoWild Safaris.

Clients retain the full legal right to pursue claims against the insurer for any valid legal liability that Delta EcoWild Safaris may owe them under these terms.

We strongly recommend that all clients take out comprehensive travel insurance covering medical emergencies, cancellations, lost baggage, and personal liability before joining the safari.

9. Indemnity

  • Clients indemnify the Operator against claims from dependents or group members.
  • Clients are responsible for damages caused to the Operator.
  • Clients must sign any required indemnity forms at parks or historical sites.

10. Photography

  • The Operator may use photographs taken during the safari for marketing purposes without client permission or compensation.

11. Bookings & Payment

  • Deposit: 20% within 14 days of confirmation.
  • Full payment must be made free of deductions in the currency accepted by Operator’s bank.
  • Late payments accrue 2% monthly interest.
  • Payment options: EFT, SWIFT, MasterCard/Visa (+3.5% service fee).
  • Booking is confirmed only upon issuing of an invoice.
  • Payments imply acceptance of terms.

12. Cancellations & Changes

  • Bookings may not be canceled or withdrawn without written consent.
  • No refund if a client terminates the safari early (due to illness, injury, or personal choice).
  • Clients must cover any additional costs resulting from deviations from the itinerary.
  • No refunds for missed activities due to weather, road conditions, or mechanical failure.
  • Operator will provide camping gear and vehicle if delays occur but not personal expenses or alternative accommodation.
